MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP OFFICIAL TERMS AND CONDITIONS

These are the Official Terms and Conditions (“Official Rules”) governing the MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP (“Championship”) brought to eligible U.S. residents by Capcom U.S.A., Inc. (“Capcom”).

1. Monster Hunter World: Iceborne USA Championship Overview

The Monster Hunter World: Iceborne USA Championship is a regional competition featuring the highly esteemed Capcom game, Monster Hunter World: Iceborne. The Monster Hunter World: Iceborne USA Championship is comprised of a series of time attack challenges where teams of two Players strive to complete specific Challenge Quests in the fastest time possible. The Monster Hunter World: Iceborne USA Championship will be structured in two rounds. The top four teams with the fastest completion times in the first round will move onto the final round. The team with the fastest time in the final round shall be the winning team.

 

2. Definitions

Monster Hunter World: Iceborne USA Championship: The U.S.-region’s competitive Monster Hunter tournament event, to be held on February 29, 2020, and which shall feature Capcom’s video game title “Monster Hunter World: Iceborne”.  The Monster Hunter World: Iceborne USA Championship will be structured in two rounds: the Qualifying Round and the Final Round.

 

Challenge Quests: A quest from the “Challenge Quest” mode of Monster Hunter World: Iceborne. Two quests from the Challenge Quest mode will be used in the Monster Hunter World: Iceborne USA Championship: “Arena Quest 01”; and “Aiming For The Light”.

 

Qualifying Round: The first round of the Monster Hunter World: Iceborne USA Championship. The Qualifying Round will be conducted using the “Arena

Quest 01” Challenge Quest. All teams will attempt to complete this quest in the fastest possible time. The four fastest teams will move on to compete in the Final Round.

 

Final Round: The second, and final, round of the Monster Hunter World: Iceborne USA Championship. The Final Round will be conducted using the “Aiming For The Light” Challenge Quest. As in the prior Qualifying Round, competing Players will attempt to complete this Challenge Quest in the fastest possible time.

 

Championship Entities: Capcom, its parent, subsidiaries, affiliates, distributors, agents and any entity involved in the implementation, execution, prizing and prize fulfillment of the Monster Hunter World: Iceborne USA Championship.

 

Grand Prize Winner(s): The team with the fastest completion time in the Final Round will be the Grand Prize winner of the Monster Hunter World: Iceborne USA Championship.

 

3. Championship Date and Location

The date of the Monster Hunter World: Iceborne USA Championship is February 29, 2020 at 5:00 pm Eastern Standard Time (EST) and located at 279 Tremont Street, Boston, Massachusetts, 02116.

 

4. Player Eligibility

The Monster Hunter World: Iceborne USA Championship is open to all eligible United States residents aged 21 years or older as of February 29, 2020. All Players must present a valid government-issued photo identification.

All eligible United States residents to participate in the Monster Hunter World: Iceborne USA Championship will be referred to as “Players.”

Employees, directors and officers, and their immediate families (spouses and siblings, parents and children and their spouses) of Capcom, its parent, subsidiaries, affiliates, distributors, agents and any entity involved in the implementation, execution, prizing and prize fulfillment of the Monster Hunter World: Iceborne USA Championship are not eligible to participate in the Monster Hunter World: Iceborne USA Championship.

 

5. How To Enter

Players can find information regarding the Monster Hunter World: Iceborne USA Championship at http://www.monsterhunterfesta.com

Registering as a Team: Players must register online as a team of two people.  Online registration will remain open until the earlier of (i) the time when all team tournament spots have been filled or (ii) 4:00pm Eastern Standard Time (EST) on February 29, 2020.  Ten United States Dollar entry fee per Player (Twenty United States Dollars total) will be required at the time of registration and both Players must agree to the Official Rules. Both registering Players must provide proof of all necessary identification documents to ensure eligibility. The registering Players must be the same pair of individuals which will compete as a team in both the Qualifying and the Final Round, and each Player must have a valid Photo I.D. that matches the registered names at the time of entry to the event.

 

Each registered Player will receive one tournament T-shirt and one custom Monster Hunter beanie while supplies last.

 

All Players that register online as a team must check-in with the Monster Hunter World: Iceborne USA Championship front desk staff by 4:00pm Eastern Standard Time (EST) on February 29, 2020, in order to confirm their attendance. Players that fail to do so will forfeit their participation and Capcom reserves the rights to open their spot for other Players. No refunds will be provided.

 

By registering to participate in the Monster Hunter World: Iceborne USA Championship, Player hereby grants to Capcom and each of its designees permission to record, videotape and photograph the Player including any Player-customized character, names, likenesses, voice, conversation and any other attributes of the Playerʼs personality and appearance (“Player Images”). All Player Images will be owned by Capcom. Player grants to Capcom and each of its designees, the right to use, edit, adapt, post, stream, copy, display, perform, transmit, broadcast, and otherwise exploit Player Images, individually or with others, in whole or in part, alone or in conjunction with other material, in any and all media now known or hereafter devised , in perpetuity throughout the world, for the purpose of trade, advertising, promotion or any other lawful purpose whatsoever, without additional compensation, consideration, notification or permission, except where prohibited by law.

 

Limit one registration per Player. Players are only allowed to register once as an individual on a team, and Players shall in no event be allowed to participate more than once in either the Qualifying Round and/or the Final Round. Physical prizes are only given at the event and a limit of one set of participation prizes will be given per registered Player.

 

6. Agreement to the Official Rules

By participating in the Monster Hunter World: Iceborne USA Championship, Player fully and unconditionally agrees to and accepts these Official Rules, which are final and binding in all matters related to the Championship. Receipt of any prize is contingent upon the Player’s compliance with all of these Official Rules.

 

7. Rules of Play

The Monster Hunter World: Iceborne USA Championship will be conducted using standardized hardware (PlayStation 4 Pro systems; DualShock 4 controllers; standardized monitors) and software (Monster Hunter World: Iceborne custom development build with balance changes reflected in the retail version 12.10 graphics option set to “Prioritize Framerate”; language set to “English”; interface size items set to “default”). Players will be allowed to customize any in-game options and menus, test said options in a practice run and make any final adjustments . Once the final adjustments are completed, the settings are final and there will be no further adjustments or customizations. Players will not be allowed to bring and use their own software, hardware and/or equipment.

 

In the event of a malfunction of the Monster Hunter World: Iceborne software or any standardized hardware at the Championship, the participating team, at Capcom’s discretion, may be allowed to restart the affected Challenge Quest attempt.

 

8. Code of Conduct

All Players are expected to maintain respect for one another and for all Championship staff and spectators. Any Player behaving inappropriately, or not competing in compliance with these Official Rules, may be immediately disqualified from the Monster Hunter World: Iceborne USA Championship and forfeit all potential prizes at the discretion of Capcom. Inappropriate behavior includes, but is not limited to, the following:

  1. Swearing, screaming or threats

  2. Harassment

  3. Violence

  4. Collusion

  5. Cheating of any sort through any means

  6. Intentionally delaying or slowing gameplay

  7. Intentionally disconnecting network cables

  8. Intentionally interrupting network connectivity

  9. Any other known or unknown manner of tampering with gameplay

  10. Any other type of conduct deemed inappropriate at Capcom’s sole discretion

 

Players agree to be bound by the decisions of Capcom and anyone acting on Capcomʼs behalf, which shall be final and binding in all respects. Capcom reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the type, process, or operation of the Monster Hunter World: Iceborne USA Championship, or to be acting in violation of these Official Rules. Capcom reserves the right, at its sole discretion, to ban infringing Players from any future Capcom event if deemed necessary.

 

Capcom will not allow, and will not allow third parties, to display, advertise, or otherwise promote in any manner, sponsorship, endorsement or other commercial affiliation with or by adult content sponsors, such as a publisher of pornographic websites, or companies that manufacture, sell, distribute or market cigarettes or vaping (e-cigarette ), drugs, guns or other weapons on Capcom’s official media content or channels, such as event video streaming and social media, in connection with the Monster Hunter World: Iceborne USA Championship.

Players further acknowledge and agree that Capcom reserves the right, in its sole discretion, to prohibit a Player from displaying, advertising, or otherwise promoting in any manner, sponsorships, endorsements or other commercial affiliation with or by any enterprise offering any products or services.

 

CAUTION: ANY DELIBERATE ATTEMPT TO DAMAGE ANY WEBSITE OR EQUIPMENT, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CAPCOM RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES AVAILABLE TO IT TO THE FULLEST EXTENT PERMITTED BY LAW.

 

9. Prizes

Subject to the Winners’ eligibility and their acceptance of all applicable requirements associated with their receipt of such prizes, as set forth in these Official Rules, the Winners of the Monster Hunter World: Iceborne USA Championship shall receive the following: 

 

  1. Each Grand Prize winner will receive a trip to attend E3 2020 from June 9, 2020 to June 11, 2020. A “Trip” shall include: (i) one round trip coach class air transportation for the Winners, originating from an airport of Capcomʼs choice near the Winners’ primary residence, to Los Angeles, California (Estimated Retail Value (“ERV”) ranging from Four Hundred United States Dollars to Seven Hundred United States Dollars; Average Retail Value (“ARV”) Five Hundred United States Dollars); (ii) four nights of hotel accommodations, checking in Monday,  June 9, 2020 and checking out Friday, June 13, 2020, for the Winners, consisting of one room, based on double occupancy (meals, telephone calls, tips, gratuities, and other incidentals and costs are not included) at a hotel of Capcom’s choosing (ERV Six Hundred United States Dollars); and (iii) round trip transportation between the airport and hotel (ERV One-Hundred United States Dollars). Each Grand Prize winner will also receive a custom Monster Hunter mini replica backpack (ERV Six Hundred United States Dollars) and a 1st place trophy (ERV One Hundred and Sixty-Five United States Dollars)

  2. Each Second place winner will receive a custom Monster Hunter mini replica backpack (ERV Six Hundred United States Dollars) and a 2nd place trophy (ERV One Hundred and Thirty United States Dollars)

  3. Each Third place winner will receive a custom Monster Hunter mini replica backpack (ERV Six Hundred United States Dollars) and a 3rd place trophy (ERV One Hundred and Thirty United States Dollars)

  4. Each Fourth place winner will receive a custom Monster Hunter mini replica backpack (ERV Six Hundred United States Dollars)

 

Each Trip and/or other prizes awarded to Winners, shall be collectively referred to as a “Prize” or “Prizes”.

 

The ERV of any Prize is subject to change based on current market conditions at time of Prize fulfillment, the time of travel, and the distance between departure location and Los Angeles, California. Any difference between the ERVs and the actual values, if any, will not be awarded. Winners must possess all necessary identification in order to be eligible to receive the Trip. Winners must travel on same itinerary. Capcom is not responsible for any fees or additional charges resulting from Winners’ change to itinerary or accommodations.

 

Notwithstanding anything to the contrary, the Prizes that can be received by a Player may be modified and/or limited on account of the laws and regulations of the state in which the Prize recipient resides.  

Additional prizes may be added by Capcom at Capcomʼs sole discretion. Additional prizing is not guaranteed and may be given at the event. For updates on additional prizing, please see http://www.monsterhunterfesta.com

 

10. General Prize Restrictions

All costs and expenses not specifically listed in Section 9 above as part of the Prizes, including, without limitation to meals, snacks, beverages, mini-bar, entertainment, tips, gratuities, souvenirs, personal expenses, incidentals, damage to hotel rooms, baggage fees, travel insurance, departure taxes and fees, any equipment to be used in connection with the Prizes, and the like, are solely Winnersʼ responsibility. The Prizes are provided “as is”.

Capcom will determine the airline and hotel in its sole discretion. Travel restrictions, conditions and limitations may apply. Travel arrangements are subject to availability and must be roundtrip. Capcom shall not be responsible for any damage to baggage or any cancellations, delays, diversions or substitutions or any acts or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of the services and accommodations necessitated by same.

 

Player’s whose placement at Championship has resulted in the award of any prizes shall be required to execute an Affidavit of Eligibility and Liability/Publicity Release, a Form W-9, or such other applicable tax information form as disseminated by the Internal Revenue Service and any required payment information forms (“Winner Forms”) within five (5) business days of Player’s determination of eligibility to receive a Prize. If a Player fails or refuses to sign and return all the Winner Forms within five (5) business days of Player’s determination of eligibility to receive a Prize, the Player and/or his or her team may be disqualified. In the event a Player and/or his or her team is disqualified, Capcom reserves the right, but not the obligation, to award the affected Prize to the next fastest Player and/or team from the Final Round. Within thirty (30) business days of receiving an executed copy of the Winner Forms, Capcom shall deliver and/or ship to the Player the applicable Prize(s). Failure to take delivery of any Prize may result in forfeiture, and such Prize may be awarded to an alternate Player. Prizes may not be transferred or assigned until after a Player has complied with all his or her obligations under these Official Rules. No cash or other substitutions may be made, except by Capcom, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by Capcom in its sole discretion.

 

By participating in the Monster Hunter World: Iceborne USA Championship, Players acknowledge that Capcom has not and will not obtain or provide insurance of any kind relating to the Prizes and that each Player will be responsible for obtaining and paying for any life, travel, car, accident, property or other form of insurance relating to the Prize(s) won by him or her.

 

Players will be responsible for all taxes (including but not limited to federal, state, local and/or income) on any Prize won and on the value of any items or value transferred to the Player by Capcom, as the case may be, and will be required to provide his/her Social Security number, IRS Form W9, or equivalent information for tax reporting purposes (as determined in Capcom’s sole discretion, at a time to be determined in Capcom, and which may be prior to participation in the Monster Hunter World: Iceborne USA Championship or prior to receipt of any Prize by Player). Capcom, as the case may be, will file an IRS Form 1099 or equivalent tax withholding documentation with the Internal Revenue Service for the retail value of any Prize or other items of value transferred to the Player by Capcom, in accordance with IRS requirements. Capcom, as the case may be, may also share such documentation with a state or local government agency as required by law. Refusal or failure of a Player to satisfy the requirements of all necessary and appropriate tax, withholding or other required compliance terms (including Social Security number, IRS Form W9, or equivalent information), as determined by Capcom in its sole discretion, will result in the Player forfeiting the Prize(s) and an alternate Player being selected in accordance with these Official Rules.

 

11. Rules of Succession

In the event that the Winners are or become ineligible or decline to receive a Prize then those Winners shall forfeit their Prize (or the applicable portion thereof), and the Prize (or applicable portion thereof) shall be awarded to the next eligible Players with the fastest Final Round completion time, or otherwise in Capcom’s sole discretion.

 

12. Limitations of Liability

CAPCOM HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH REGARD TO THE MONSTER HUNTER WORLD: ICEBORNE GAME SOFTWARE, EQUIPMENT, OPERATION OF THE CHAMPIONSHIP, OR PRIZING, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, AND THEIR EQUIVALENTS, UNDER THE LAWS OF ANY JURISDICTION.

 

As between the Players and Capcom, Capcom shall not be responsible for any of the following:

  1. incorrect or inaccurate information whether caused by users or by any of the equipment or programming associated with or utilized in the Monster Hunter World: Iceborne USA Championship or by any technical or human error which may occur in the processing of a Playerʼs registration or gameplay;

  2. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access which may result in alteration of gameplay or game results;

  3. any problems or technical malfunction of any network or lines, servers or providers, equipment, or software, including any injury or damage to Player resulting from participation in the Monster Hunter World: Iceborne USA Championship;

  4. any damage, injury or loss to a Player arising or resulting from the destruction or loss, alteration, unauthorized disclosure or access to Player’s PlayStation Network account, or any entitlements thereto;

  5. injuries or losses to Playerʼs person or property arising or resulting from participation in the Monster Hunter World: Iceborne USA Championship;

  6. any acts or omissions by Championship Entities or their employees, whether negligent or willful, in the conduct of the Monster Hunter World: Iceborne USA Championship;

  7. any equipment or software malfunction; or

  8. the inability to complete a game due to any technical malfunction.

 

Capcom, in its sole discretion, may require the replaying of any round, or declare any of the foregoing null and void by reason of any technical or other system error. If for any reason the Monster Hunter World: Iceborne USA Championship or any portion thereof is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other causes beyond the control of Capcom which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Monster Hunter World: Iceborne USA Championship or any portion thereof, Capcom reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Monster Hunter World: Iceborne USA Championship or any portion thereof. Without limiting the generality of the foregoing, in the event that Capcom determines, in its sole discretion, that any individual round has been tampered with or that the validity of any round has been compromised for any reason, it may eliminate that round, and conduct the Monster Hunter World: Iceborne USA Championship on the basis of the remaining rounds. In the event that any individual is adversely affected in a round by any technical or equipment malfunction, Capcom reserves the right to schedule special round among any such competitors so adversely affected. In the event of any cancellation, termination, modification or suspension of the Championship or any portion thereof, Capcom will post a notice at http://www.monsterhunterfesta.com.

 

BY ENTERING AND PARTICIPATING IN THE MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP, PLAYERS AGREE TO INDEMNIFY, DEFEND, RELEASE AND HOLD HARMLESS CAPCOM, AND THEIR RESPECTIVE PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, EXPENSES, COSTS (INCLUDING REASONABLE ATTORNEYSʼ FEES) AND LIABILITIES (INCLUDING SETTLEMENTS) FOR ANY INJURIES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY OR DEATH, OR LOSS OR DAMAGE OF ANY KIND, ARISING FROM OR IN CONNECTION WITH THE MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP, ATTENDANCE AT THE MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP, OR ANY PRIZE, OR ANY OTHER MATTER OR ACTIVITY DIRECTLY OR INDIRECTLY RELATED TO THE MONSTER HUNTER WORLD: ICEBORNE USA CHAMPIONSHIP, INCLUDING BUT NOT LIMITED TO LIBEL, SLANDER, DISPARAGEMENT, DEFAMATION, COPYRIGHT INFRINGEMENT, INVASION OF PRIVACY, PIRACY, PLAGIARISM, OR INFRINGEMENT OF ANY PATENT, COPYRIGHT, TRADEMARK, TRADE SECRET OR OTHER INTELLECTUAL PROPERTY RIGHT OF ANY THIRD PARTY. THIS OBLIGATION SHALL CONTINUE BEYOND THE TERM OF THE CHAMPIONSHIP.

 

13. Disputes

By participating in the Monster Hunter World: Iceborne USA Championship, Players agree that (i) any and all disputes, claims and causes of action arising out of, or connected with the Monster Hunter World: Iceborne USA Championship or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in San Francisco County, California; (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering and participating in the Monster Hunter World: Iceborne USA Championship, and in no event shall any Player be entitled to recover attorneysʼ fees; and (iii) under no circumstances will any Player be permitted to, and each Player hereby waives all rights to, claim or recover punitive, incidental, consequential and/or special damages or any other damages (other than out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Playersʼ rights and obligations, or the rights and obligations of Capcom in connection with the Monster Hunter World: Iceborne USA Championship, shall be governed by, and construed in accordance with California law without regard to choice of law or conflict of law rules.

 

14. Sponsor

Capcom U.S.A., Inc. shall be the sponsor/administrator/organizer of the Monster Hunter World: Iceborne USA Championship for the purposes of fulfilling all such sponsor/administrator/organizer obligations under any applicable contest law, including, but not limited to, disclosure obligations.

 

15. Reserved Rights

Capcom reserves the right, in its sole discretion, to revise, update, change, modify, add to, supplement, or delete certain terms of the Official Rules for any reason. Such changes will be effective with or without prior notice. The most current version of the Official Rules is posted at http://www.monsterhunterfesta.com.
